Ordering and booking - conclusion of the transport contract

A transport contract is concluded by ordering and subsequent confirmation by Tirol Bus GmbH or its booking partner. The order is placed online on the Internet, in our booking office in Bolzano or in a conventional travel agency.
The correct transmission of passenger data (telephone number!), as well as the flight number and flight times for the outward and return flights are the sole responsibility of the customer.
The scope of services and transport price are based on the valid prices in the booking portal.
Bookings made by telephone cannot be accepted due to possible transmission errors.
The customer must immediately check the booking confirmation or the invoice issued for errors, inaccuracies or discrepancies and immediately inform Tirol Bus GmbH of these.
The transport contract is not concluded in particular if the customer has provided incomplete or incorrect information about the purpose of the contract.

Content of the contract

The travel service of the group transfer is based on the description of the booking.
Tirol Bus GmbH reserves the right to make changes to the service, provided that they do not affect the core of the service. The content of the services is described in the current implementation guidelines. The prices apply to a pick-up address and a one-way route.
The price includes two suitcases and one piece of hand luggage per adult.

You are only entitled to transport at the agreed time.

When booking, please ensure that your details regarding departure and arrival times match the corresponding data on your flight ticket and on the transfer confirmation - please also bear in mind that for flights from overseas, the departure date may not match the arrival date at the arrival airport.

Tirol Bus GmbH always follows the information provided in the order and cannot be held liable for incorrect information.

If the departure date is given instead of the arrival date, the right to transport expires on the arrival date and the transfer must be rebooked and paid for.

Due to the group transport, waiting times within reasonable limits (up to a maximum of 90 minutes) cannot be ruled out when picking up at the airport if the scheduled landing occurs. Early landings or delays to incoming flights can lead to longer waiting times.

Passengers are obliged to immediately inform us of any changes to the booking that occur after the order has been placed. Short-term changes to the flight number must be reported by telephone.

In the event of delays that the passenger is already aware of at the departure airport, the passenger is obliged to cooperate.

The office in Bolzano or the emergency telephone must be informed of the expected new arrival time at the airport.

Exceptional situations such as strikes, war, civil unrest, natural and other disasters, orders from the authorities or extremely bad weather conditions cannot be dealt with by Tirol Bus GmbH, or only to a limited extent, so that longer waiting times must also be accepted by the customer.

Tirol Bus GmbH is solely responsible for determining the pick-up times for passengers in the shared transfer. They are based on the travel time, traffic jam buffers and the regulations of the charter and scheduled airlines.

If the customer chooses to arrive at the airport shortly before the departure time (less than 60 minutes for scheduled flights in Schengen countries, less than 120 minutes for all others or less than the airline's specifications), the customer alone bears the risk of reaching the flight.

The customer is obliged to help resolve any service disruptions and to avoid or minimize any damage.

Travel documents

Passengers must carry a valid passport or other valid travel document, as well as any necessary residence and transit visas and any medical certificates during the journey.

Passengers must also observe the rules of normal caution and care and follow the administrative and legal instructions and regulations related to the journey.

Before the trip, passengers must inform themselves about the required travel documents from the relevant municipality, police station, consulate or embassy and also check the validity of their travel documents.
The passengers are liable for any damage caused to the transport company by failure to meet the above obligations.
Copies or photos of travel documents are not valid under any circumstances!

Collection of the customer

Tirol Bus GmbH informs the customer of the expected pick-up time when the booking is confirmed. The planned pick-up time is a time window of one hour.
The day before the booked trip, the customer will receive an SMS and an email with your exact pick-up time in the early evening (4:00 p.m. - 6:00 p.m.).

If the customer does not receive a notification, he must contact the office or the emergency number immediately.

On the day of departure, the customer will receive another message with the name and telephone number of the driver 1 hour before pick-up.

The determination of pick-up times for shared transfers is the sole responsibility of Tirol Bus GmbH. The pick-up is always planned according to external influences (weather, road conditions, traffic forecasts) in order to ensure punctual arrival at the airport and to be able to adhere to the check-in times specified by the airline.

For pick-ups from the airport, a check-out time of at least
20 minutes for hand luggage and
45 minutes for checked luggage
from the scheduled landing must be expected.

As a rule, we cannot react to early landings.

Luggage

Two suitcases and one piece of hand luggage per adult are transported at no extra charge.

Surcharges are charged for excess baggage and bulky luggage, as larger vehicles usually have to be used in these cases.

Excess baggage, bicycles, golf bags, ski luggage, diving equipment, surfboards and other bulky luggage must be declared when booking.

Bicycles must be packed in a box or in appropriate luggage bags with the front wheel removed.

The respective surcharges can be found in our booking portal.

Unregistered excess baggage can only be transported in exceptional cases and for a reasonable surcharge. The amount of the surcharge depends on the additional logistics effort required.

If unregistered excess baggage cannot be transported due to a lack of transport options, the customer must leave it behind when picking it up.

Tirol Bus GmbH is not liable for items of luggage, their contents, animals and articles of any kind, electronic devices and various goods and items.

Every passenger is obliged to personally hand over their luggage, which must be clearly marked with a luggage tag or name tag, to the driver when loading the vehicle and to check the completeness and correctness of the items of luggage themselves upon arrival - Tirol Bus GmbH is not liable for lost, mixed up or forgotten luggage.

Transport of small pets

Small dogs, cats and other small pets can be transported in a transport container (max. 70x30x50 cm.) for an additional charge.

One transport container per passenger is permitted.

The customer must carry the legally required transport documents for transporting animals on the journey.

Larger animals cannot be transported.

Behavior in the vehicle

Smoking and alcohol are expressly prohibited in the vehicle, and seat belts must be worn.

Customers who appear visibly drunk or drugged at the departure point lose their right to transport and are not allowed to board the vehicle.

The drivers are authorized to exclude people who are obviously drunk or under the influence of other drugs from transport. The same applies to passengers who endanger the safety of other passengers for other reasons or who have a significant negative impact on the well-being of fellow passengers.

Smoking in the vehicle is not permitted, not even with electronic cigarettes.

Tirol Bus GmbH has a claim against customers for reimbursement of the costs and expenses required to repair damage and contamination that passengers cause to the vehicle.

Flight delays or missed connecting flights

Tirol Bus GmbH cannot accept any liability for delays in air traffic or for missed connecting flights. In such cases, the person who caused the damage is solely liable.

However, Tirol Bus GmbH always endeavours to rebook passengers onto a later journey free of charge, if possible. However, Tirol Bus GmbH is under no obligation to do so.

Cancellations and refunds

Both contracting parties have the right to withdraw in accordance with the statutory provisions.

For cancellations within 48 hours before the start of the service, Tirol Bus GmbH charges 100% of the agreed price for the one-way transfer. Cancellations or rebookings for the return transfer remain free of charge.

Cancellations generally trigger a processing fee of at least EUR 30.00 per booking.

Depending on the effort involved, a processing fee of up to EUR 20.00 per booking may be charged for rebookings.

If the passenger does not show up at the agreed time (no show), the fare already paid will be retained in full or the full fare will be charged.

Reservation deadlines

Reservations should be made at least 3 days before the start of the trip.

For short-term registrations, we can only make remaining places available, which may result in longer waiting times.

Liability

Tirol Bus GmbH cannot be held liable for the consequences of delays due to traffic congestion, traffic accidents, unforeseen road closures or traffic jams. Liability for the consequences of delays due to slight negligence is excluded.

Tirol Bus GmbH can only compensate for exceptional situations such as strikes or extremely bad weather conditions to a limited extent. In these cases, longer waiting times must also be accepted.

Passengers who do not arrive at the booked stops on time lose their right to transport.

The vehicles used are regularly serviced and are properly registered and insured.

Tirol Bus GmbH is entitled to have journeys carried out by service providers.

Shared transfer

With the South Tyrol Bus, Tirol Bus GmbH connects departures and arrivals within a certain time period; accordingly, passengers may have to wait at the airport for a reasonable amount of time.

When making a reservation, each Tirol Bus GmbH customer receives the pick-up time, which can change depending on the route, traffic and weather conditions, although these time changes do not normally fall short or exceed 15 to 90 minutes.

If the driver is more than 10 minutes late picking up the customer at the stop, the customer must call the emergency number immediately. This way, any problems can be dealt with in good time in the interest of the customer.

Private transfer

For our demanding customers or customers who have a specific appointment, we recommend our private transfer.

In contrast to the shared transfer with set departure times, the customer is served individually with a special trip.

The customer can book 1 to 78 people at the private transfer price as desired.

Any waiting times are also eliminated.

General and exclusion of liability

There is generally no obligation to accept a transport order.

The scope of services and transport prices can be viewed online in the booking portal.

Tirol Bus GmbH accepts no liability for technical failures of the internet service and the connected databases.

The transport prices are generally based on the booking portal.

Data processing and confidentiality

Tirol Bus GmbH may process the data provided by the customer insofar as this is necessary to carry out the contract. The customer expressly agrees that the data collected will only be used for operational processes.
Tirol Bus GmbH undertakes to maintain confidentiality towards customers/passengers.

Severability clause

If one of the above clauses is invalid, this does not change the validity of the contract. Invalid clauses are replaced by the statutory provisions.

Complaints

All defects in the execution of the contract must be complained about immediately by the customer so that Tirol Bus GmbH can remedy the situation in a timely manner.
Otherwise, the customer must submit his complaint in writing by registered mail with confirmation of receipt or PEC email, which must be sent to Tirol Bus GmbH within 10 working days of the service being provided.

Online dispute resolution and jurisdiction

As a consumer, you can use the online dispute resolution (ODR) platform provided by the European Commission to resolve any disputes arising from online purchases on our website, after contacting us, which you can find at http://ec.europa.eu/consumers/odr/ (online dispute resolution in accordance with EU Regulation no. 524/2013).

For any legal disputes in connection with this contract, the exclusive jurisdiction lies with the Regional Court of Bolzano, without prejudice to the jurisdiction for consumers (residence of the end consumer).
